1. Introduction
Welcome to Dondo – The Talking Drum ("Dondo," "we," "our," or "us"). By accessing or using our mobile application and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms").
Please read these Terms carefully before using Dondo. If you do not agree to these Terms, you may not access or use the Service.
These Terms should be read alongside our Privacy Policy, which explains how we collect and use your personal information.
2. Eligibility
You must be at least 13 years of age to use Dondo. By using the Service, you represent and warrant that:
- You are at least 13 years old
- You have the legal capacity to enter into these Terms
- You will comply with all applicable laws and regulations
- You are not prohibited from using the Service under any applicable law
If you are under 18, you represent that you have your parent or guardian's permission to use the Service.
3. Account Registration
To use certain features of Dondo, you must create an account. When you register, you agree to:
- Provide accurate information – Your registration information must be truthful and current
- Maintain account security – You are responsible for all activity under your account and for keeping your password confidential
- One account per person – You may not create multiple accounts or share your account with others
- Notify us of breaches – You must immediately notify us of any unauthorized access to your account
4. Acceptable Use & Community Guidelines
Dondo is designed for structured, civil debate. When using the Service, you agree to:
- Engage respectfully – Debate ideas, not people. Personal attacks are not permitted.
- Follow debate structure – Respect turn-taking, time limits, and the structured format of debates
- No harassment – Do not threaten, intimidate, stalk, or harass other users
- No hate speech – Content that promotes hatred or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics is prohibited
- No spam – Do not send unsolicited messages, advertisements, or promotional content
- No impersonation – Do not pretend to be someone else or misrepresent your affiliation
5. Prohibited Content & Behavior
The following content and behavior are strictly prohibited on Dondo:
- Illegal content – Any content that violates applicable laws
- Harassment and bullying – Targeting individuals with repeated unwanted contact or abuse
- Hate speech – Content promoting hatred against protected groups
- Violent threats – Threats of violence or harm to any person
- Sexually explicit content – Pornography, nudity, or sexual content
- Misinformation – Deliberately false or misleading information that could cause harm
- Malware or hacking – Attempts to compromise the security of the Service or other users
6. Child Safety Standards
Dondo has a zero tolerance policy for child sexual abuse and exploitation (CSAE). We are committed to keeping minors safe on our platform.
Prohibited Content and Behavior
The following are strictly prohibited and will result in immediate account termination and reporting to law enforcement:
- Child sexual abuse material (CSAM) – Any sexual imagery involving minors
- Grooming – Attempting to build relationships with minors for exploitation
- Exploitation of minors – Any content or behavior that sexualizes, endangers, or exploits children
- Solicitation – Requesting inappropriate content or contact with minors
How to Report
If you encounter any content or behavior that may constitute child exploitation:
- In-app reporting – Use the report feature within the app to flag concerning content or users
- Email – Contact us directly at [email protected]
Our Response
When we receive reports of potential CSAE, we will:
- Immediately remove the content
- Permanently terminate the offending account
- Report confirmed CSAM to the National Center for Missing & Exploited Children (NCMEC)
- Cooperate with law enforcement investigations
- Preserve evidence as required by law
Legal Compliance
Dondo complies with all applicable child safety laws, including the PROTECT Act and relevant state and international laws. We actively participate in industry efforts to combat child exploitation online.
7. User-Generated Content
Dondo allows you to submit content including debate arguments, stance positions, and profile information ("User Content"). By submitting User Content, you agree that:
- You own your content – You retain ownership of your User Content
- License to Dondo – You grant Dondo a non-exclusive, royalty-free license to use, display, and distribute your User Content in connection with operating the Service
- Responsibility – You are solely responsible for your User Content and the consequences of posting it
- We may remove content – We reserve the right to remove any User Content that violates these Terms
8. Intellectual Property
The Service, including its original content, features, and functionality, is owned by Dondo and is protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of the Service or its content, nor may you reverse engineer or attempt to extract the source code, unless you have our written permission or applicable law permits it.
9. Third-Party Services
Dondo uses the following third-party services to operate. Your use of these services is governed by their respective terms:
LiveKit (Video Streaming)
Supabase (Backend Services)
PostHog (Analytics)
Sentry (Error Tracking)
10. Disclaimers & Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:
- The Service will be uninterrupted or error-free
- Defects will be corrected
- The Service is free of viruses or harmful components
To the maximum extent permitted by law, Dondo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
We are not responsible for the content, accuracy, or opinions expressed by users. User Content does not reflect the views of Dondo.
11. Account Termination
Our Right to Terminate
We may suspend or terminate your account at any time if you violate these Terms or for any other reason at our sole discretion. Serious violations, including CSAE or threats of violence, may be reported to law enforcement.
Your Right to Delete Your Account
You can delete your account at any time through Settings > Account Security in the app. We offer two deletion options:
- Scheduled deletion – Your account will be deleted after a grace period of 1-30 days (you choose). You can cancel during this period.
- Immediate deletion – Your account and data are permanently deleted. This cannot be undone.
When your account is deleted, the following data is permanently removed: your profile, stance assessments, debate history, badges, time bank balance, and challenge history.
You can export your data before deletion. Visit /delete-account for more information.
12. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will:
- Update the "Last updated" date at the top of this page
- Notify you via email or in-app notification for significant changes
Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
